CAPTURED! Sex Offender in Forsyth Jail

A wanted sex offender is in custody in Forsyth County.

A man wanted by the Forsyth County Sheriff's Office for failing to register as a sex offender has been captured by authorities and is in custody.

Michael David Westbrook, 48, was apprehended after Gwinnett County Police received a 911 call about a "person down" on Thursday evening, Aug. 8.

"Westbrook had passed out and was awake when the officer asked for his ID," said Deputy Sheriff Doug Rainwater of the FCSO. "Westbrook told the officer he was wanted out of Forsyth."

According to the Georgia Bureau of Investigation, Westbrook was convicted on Nov. 3, 1997 for kidnapping. His last known registered address was 7905 Holyoke Road, Cumming, GA 30040.

Rainwater told Cumming Patch after Westbrook moved to Forsyth County, the FCSO did a check to see if he was living where he said he was living, but had "taken off" without notifying the sheriff's office.

As of Monday, Westbrook is in the Forsyth County jail.

"He has already seen a judge on first appearance," said Rainwater. "Bond hearing is soon."

The GBI reports that any individual who is required to register as a sex offender and fails to do so, “shall be guilty of a felony and shall be punished by imprisonment for not less than one nor more than 30 years; provided, however, that upon the conviction of the second offense under this subsection, the defendant shall be punished by imprisonment for not less than five nor more than 30 years.”
