Public Hearing on Sunday Alcohol Sales Thursday

The Forsyth County BOC will hold a public hearing Thursday to consider amending the ordinance on Sunday alcohol sales if voters approve the referendum on March 6.

A public hearing will be held by the Forsyth County Board of Commissioners to consider amending the ordinance on Sunday alcohol sales. The hearing will take place during the Board's regular meeting Thursday, Feb. 2 at 5 p.m.

The public hearing will be held in the Forsyth County Administration Building (Suite 220), located at 110 E. Main Street in Cumming.

According to Ordinance Number 68, the modifications include the following:

Section 2.5 Hours of Sale

  • Retail package outlets shall engage in the sale of beer and/or wine only between the hours of 6 a.m. and 11:45 p.m. Monday through Saturday, and between the hours of 12:30 p.m. and 11:30 p.m. on Sundays.
  • No package beer and/or wine may be sold on Christmas Day.

  • The sale of beer and wine is allowed on election days provided that the outlet is not located within 250 feet of a polling place.

Section 3.4 Hours of Sale

  • The sale of distilled spirits by the package shall occur only between the hours of 9 a.m. and 11:45 p.m. Monday through Saturday, and between the hours of 12:30 p.m. and 11:30 p.m. on Sundays.
  • All customers must be out of the licensee’s establishment no later than 15 minutes after the time at which sales of distilled spirits must cease.
  • No sale of distilled spirits by the package shall occur on Christmas Day.
  • The sale of distilled spirits by the package is allowed on election days provided that the outlet is not located within 250 feet of a polling place.

If voters approve Sunday alcohol sales the ordinance will become effective on March 18, if Forsyth County has declared the certified election results by that date, or on the first Sunday following certification of the election results if such certification occurs after March 16.

If the referendum is not approved, the ordinance will not become effective and be deemed repealed without further action by the Board of Commissioners.
